MLB Fan Hit by Ball Unable to Revive Suit Against Net Maker

A sports netting manufacturer avoided having to face reinstated claims by a Pittsburgh Pirates fan hit by a foul ball that deflected off its netting, after the Pennsylvania high court declined to review a state appeals court ruling.

The Pennsylvania Supreme Court on Tuesday let stand a ruling that the trial court wasn’t obliged to give a jury instruction that Promats Athletics LLC had a heightened duty of care to plaintiff Wendy Camlin, compared to the Pittsburgh Pirates organization and the Sports and Exhibition Authority of Pittsburgh and Allegheny County, who both settled before trial.
