Mentally Ill Woman Can Sue Hospital for Emotional Distress

Montage Health must answer claims employees at its Northern California hospital intentionally caused a mentally ill woman severe emotional distress when they refused to take seriously her claim that she’d been sexually assaulted.

Kelly Schramm has adequately alleged claims against Montage, which operates Community Hospital of the Monterey Peninsula, and against a nurse, and a security guard, for intentional infliction of emotional distress, assault and battery, and false imprisonment, the U.S. District Court for the Northern District of California said July 1.
