MAM ‘Orthodontic’ Pacifier Consumer Deception Suit Advances

MAM USA Corp. must continue defending against a proposed class suit alleging it duped parents who bought “orthodontic” pacifiers for their young children, an Illinois federal court ruled.

Dominique Freeman plausibly alleged consumers could interpret the term “orthodontic” as promising to improve dental health outcomes by positioning teeth and jaws for proper development, the U.S. District Court for the Northern District of Illinois said Tuesday.

Yet the pacifiers don’t promote proper oral development or provide any other benefit to children, and extended use of any pacifier can be harmful, she alleges.
