Five San Diego area convenience stores and gas stations that sell male sex pills will avoid a Lanham Act false advertising claim by a maker of competing enhancement products that said their products resulted in lost business, the Southern District of California said.
Outlaw Laboratory LP, maker of “TriSteel” products, alleged that Eashou Inc., which does business as San Diego Cash and Carry, and the others fraudulently sold sex pills as “all natural” when they actually contained hidden prescription ingredients.
