Laundress LLC convinced a federal judge to dismiss a handful of claims in a consolidated product liability lawsuit, but he advanced most claims alleging deceptive advertising and warranty breaches related to a recall of laundry detergent and household cleaning products due to bacterial contamination.
The US District Court for the Southern District of New York on Tuesday dismissed an unjust enrichment claim as duplicative and a failure to warn claim as insufficiently pleaded. It otherwise denied Laundress’ motion to dismiss.
