LG Refrigerator Suit Survives Dismissal Motion

Implied warranty claims in a would-be consumer class action alleging the cooling system and ice makers on certain LG Electronics USA Inc.'s refrigerators failed to perform properly survived a dismissal motion Oct. 29 when the U.S. District Court for the Southern District of California held that the electronics company did not disclaim the warranties and that vertical privity was not required (Clark v. LG Electronics USA Inc., 2013 BL 299707, S.D. Cal., 13-00485).
