Kroger Fails to Shake Class Claims It Falsely Advertised Coffee

The Kroger Co. lost its bid to strike class allegations brought by a consumer who alleges the grocery chain misrepresented the number of cups its canisters of private-label coffee can brew.

Anthony Womick can seek to assert claims on behalf of other consumers related to products he didn’t purchase himself, insofar as the alleged injuries are “substantially similar,” Chief Judge Nancy J. Rosenstengel of the US District Court for the Southern District of Illinois said. Her Monday order rejected Kroger’s bid to partially toss the suit.
