Kraft Heinz Sheds Consumer Suit Over Capri Sun Labeling

Kraft Heinz Foods Co. won dismissal of a proposed class suit alleging its Capri Sun drinks were deceptively marketed as having no artificial preservatives when they were made with artificial citric acid, in a ruling by the Northern District of Illinois.

The plaintiffs sought money damages and injunctive relief such as marketing changes, under the consumer protection laws of Illinois and New York.

The plaintiffs’ allegations don’t link the allegedly artificial citric acid to the actual citric acid used by Kraft, the U.S. District Court for the Northern District of Illinois said Oct. 10. They haven’t stated a viable deception ...
