Kohl’s Customer Didn’t Support Fake-Sale Claims But May Refile

A Kohl’s Corp. customer didn’t support her claims that the department store chain tricks consumers with fake sales, a federal trial court in Missouri said, but it gave her another chance to assert she didn’t get the actual value of the items she bought.

Jill Hennessey alleged Kohl’s advertises its private brand merchandise with fake discounts and made-up original prices that “materially overstate” the products’ worth, violating Missouri consumer protection law. She sought to represent a Missouri class.
