Keurig Consumers Lose Do-Over Bid in K-Cup Antitrust Case

Keurig Dr Pepper Co. shored up its victory over consumer claims involving its K-Cup coffee brewer June 25 when a federal judge refused to revisit his ruling dismissing “indirect purchasers” from the antitrust lawsuit.

Judge Vernon S. Broderick tossed the consumer claims in a 114-page ruling unsealed April 24 that otherwise handed a win to Keurig competitors and resellers. Broderick let two coffee makers and a proposed class of distributors and retailers proceed with their suit accusing the company of unlawfully tying sales of its K-Cup coffee pods to its single-serve brewing machines.
