Kate Spade Lures Outlet Shoppers With Fake Sales, Suit Says

Kate Spade & Co. LLC deceives shoppers with fake sales in its outlet stores, violating California consumer protection laws, a new suit alleges.

Kate Spade creates a fake “reference” price and then offers items for sale at a deep “discounted” price, Californian Kristen Schertzer alleges in a proposed class suit in the U.S. District Court for the Southern District of California.

Kate Spade wasn’t immediately available for comment.

The suit joins a wave of deceptive pricing litigation against retailers across the country. Some have resulted in big wins for consumers: J.C. Penney settled pricing claims for $50 million in 2016. ...
