Judge Recuses Self After Plaintiffs Allegedly Flouted Order to Return to Federal Court

A federal judge voluntarily recused himself July 28 from a product liability class action involving allegedly cracking roof shingles based on a warning that he had previously given the plaintiffs’ attorneys (Brooks v . GAF Materials Corp.).

The putative state-wide class action, filed by South Carolina plaintiffs who complained that their Timberline shingles manufactured by defendant GAF Materials Corp. were subject to cracking before the warranty period expired, had bounced multiple times between state court and federal court.
