J&J Unit Must Face Suit Over Neutrogena Makeup Remover Pads

Johnson & Johnson Consumer Inc. must keep defending against a proposed class suit alleging it didn’t warn consumers that Neutrogena makeup remover pads could cause skin rashes and allergic reactions, a New Jersey federal court said.

Federal cosmetics law doesn’t preempt the deception claims, the U.S. District Court for the District of New Jersey said May 28. And Jaimie Potts and others, who allegedly suffered physical harm, have standing to sue despite a Neutrogena refund program, the court said in an unpublished opinion.
