IVF Labs Sued Over Allegedly Deceptive Genetic Test Marketing

A network of fertility labs engaged in false and deceptive marketing about the efficacy of its preimplantation genetic tests that cost consumers thousands of dollars, a new federal lawsuit claims.

Plaintiffs in the prospective class action say that FPG Labs LLC, more commonly known by its Ovation Fertility brand, and US Genetic Lab LLC, or Ovation Genetics, marketed genetic tests for the chromosomal disorder aneuploidy, or PGT-A. Ovation allegedly claimed the tests were a reliable method to decrease the chance of miscarriage and increase the likelihood of having a healthy baby as the result of in vitro fertilization.
