Injury in Phillies Charity Bike Ride Has City Owing $3 Million

Philadelphia remains on the hook for a jury award of $3.1 million in favor of a man injured in the 2015 Philadelphia Phillies Charity Bike Ride, after a divided Pennsylvania high court found a liability waiver unenforceable.

The state Tort Claims Act opens the city to liability when it has notice of a dangerous condition of the streets, the Pennsylvania Supreme Court said. And the act doesn’t authorize the city to immunize itself through “exculpatory contracts,” the court said.

The city’s duty to exercise reasonable care in discharging its duty to maintain the streets “arose long before the bike ride,” ...
