Illinois Central Railroad Can’t Beat Widow’s Suit as Untimely

Illinois Central Railroad Corp. can’t overcome a widow’s workplace exposure claims filed more than four years after her husband’s cancer diagnosis, the Northern District of Illinois said.

The court rejected the railroad’s contention that the claims are barred by Federal Employers’ Liability Act’s three-year statute of limitations.

Theresa Romcoe’s claims may proceed because it’s unclear when they accrued, the U.S. District Court for the Northern District of Illinois said Sept. 9.

It’s undisputed that Romcoe’s husband had notice of his injury when he was diagnosed with cancer in September 2013.
