Icelandic Skyr’s labeling wouldn’t deceive a reasonable consumer about the yogurt’s country of origin, the Ninth Circuit said, affirming the dismissal of a proposed consumer class action.
Rivka Steinberg alleged that consumers could believe Icelandic Provisions Inc.'s yogurt is made in Iceland because of the product name, which refers to a traditional Icelandic dairy product; the stylization of “Icelandic” in the company’s name on the label; and the image of an arctic snowy countryside on the front of the product. The yogurt is actually made with domestic and imported ingredients in Batavia, N.Y., Steinberg said.
