The Indiana Horse Racing Commission told a federal court it’s immune from suit by a veterinarian seeking damages for the summary suspension of his track vet license, for allegedly injecting a horse with a foreign substance.
The IHRC and the commissioners and employees of the agency being sued in their official capacities are entitled to 11th Amendment sovereign immunity, and aren’t “persons” liable for damages under Section 1983, the commission said in a brief filed Tuesday in the U.S. District Court for the Southern District of Indiana.
