Horse Owners Claim ‘Future Injury’ in Suit Over Anti-Doping Law

Thoroughbred racehorse owners and trainers seeking to strike down a newly enacted anti-doping and racetrack safety law told the Northern District of Texas that “the mere prospect” of having their horses inspected “at some point in the future” is enough to show injury.

“A future injury suffices for standing if it is certainly impending or there is a substantial risk that the harm will occur,” the plaintiffs told the U.S. District Court for the Northern District of Texas June 18.
