The duration of Gus Dove’s exposure wasn’t long enough to pursue a claim for asbestos-related injuries under Delaware law, the U.S. District Court for the District of Delaware said.
The state’s “product nexus standard” requires that a plaintiff present evidence of “daily and continuous proximity” to the product “for more than a de minimis period of time,” the court said.
