Homeopathic Maker Cleared of False Ad Class Claims

Boiron Inc.'s trial victory will stand over class claims that it falsely touted a homeopathic flu product at such retailers as CVS Pharmacy and Whole Foods Market, a federal appeals court ruled Nov. 8.

The jury reasonably believed Boiron’s clinical studies and anecdotal evidence related to the effectiveness of its Oscillococcinum product, the U.S. Court of Appeals for the Ninth Circuit said.

Neither side tested the product, known as Oscillo, to see if it contained any therapeutic ingredient.
