Home Depot Can’t Exit Table Saw Case as ‘Innocent Seller’

Home Depot, U.S.A. Inc. didn’t show it’s entitled to innocent retailer protection in a table saw case, a federal court in Missouri ruled Aug. 1.

Timothy Miravalle injured his left hand and fingers after he removed the Ryobi saw’s blade guard in order to make certain cuts, according to the U.S. District Court for the Eastern District of Missouri.

He sued One World Technologies Inc., which makes Ryobi tools, and Home Depot, allegedly the brand’s exclusive seller. Home Depot sought to dismiss the claims under Missouri’s Innocent Seller statute and provided an affidavit about the company’s role.
