Hoffmann-La Roche Fends Off Accutane Injury Appeal

Hoffmann-La Roche Inc. isn’t liable on a woman’s claims that Accutane, the company’s medication for chronic acne, caused her severe bowel disease, the Nebraska Supreme Court ruled May 18.

The trial court’s exclusion of an expert witness for Aimee Freeman was proper because his opinion on the link between Accutane and her Crohn’s disease was unreliable, the unanimous court said. That entitled the company to a summary judgment.

The expert, David Sachar, ignored all but one epidemiological study that found no significant link between Accutane, or isotretinoin, and inflammatory bowel disease, the court said.
