H&M Gets Consumer’s Recycled Polyester Deception Lawsuit Trimmed

H&M Hennes & Mauritz LP convinced a federal judge to dismiss some claims in a false-advertising proposed class action alleging it dupes envrionmentally-conscious consumers into believing some of its garments were made with recycled polyester.

The consumer’s claims were dismissed to the extent that they were based on representations made on H&M’s website because the complaint lacked the detail about the misrepresentations and when the consumer viewed them, the US District Court for the Eastern District of Missouri said Thursday. The claims based on physical hangtangs on the garments survived.
