Godiva Chocolatier Inc. wants a federal court to toss a suit alleging its “Belgium 1926" statement tricks consumers into thinking chocolate sold in the U.S. comes from Belgium.
Steve Hesse and Adam Buxbaum alleged they overpaid for Godiva chocolates, believing they were luxury confections imported from Belgium. The chocolate is made in Reading, Pa. Their claims include violations of New York and California consumer protection laws.
But no consumer could be fooled into thinking the chocolates come from Belgium, Godiva said in a filing to the U.S. District Court for the Southern District of New York.
