A proposed class suit alleging the makers of amino acid supplement Growth Factor-9 falsely advertised that the product could boost human growth hormone was thrown out by the Northern District of California Feb. 25 (Engel v. Novex Biotech LLC, 2015 BL 49275, N.D. Cal., 14-CV-03457-MEJ, 2/25/15).
Magistrate Judge Maria-Elena James of the U.S. District Court for the Northern District of California said plaintiff Julian Engel failed to allege facts from which she could conclude that Growth Factor-9 supplement manufacturers, Novex Biotech LLC and GNC Corp., made actionable false advertising representations.
