GM Diesel Emissions Suit Founders on Lack of Defeat Device Proof

Consumers alleging their Chevrolet Cruze diesel vehicles contain software that allows excessive emissions under real-world driving conditions must bolster their evidence of economic injury or see their case against General Motors LLC dismissed, a federal court in Michigan said.

The car owners’ expert testing of one vehicle, their testimony about their own expectations, and their damages proof doesn’t reach the level of proof of standing needed at the summary judgment stage of litigation, Judge Thomas L. Ludington said Wednesday for the U.S. District Court for the Eastern District of Michigan.
