Gerber Products Co. shook off lawsuits claiming it deceived parents by concealing the presence of heavy metals in baby foods, as a federal court in Virginia said the Food and Drug Administration must first address whether the alleged amounts are harmful.
Additionally, the parents—who say they overpaid because of Gerber’s omissions—lack standing to sue because they didn’t allege they suffered any economic harm, the US District Court for the Eastern District of Virginia said.
