GE Urges Justices to Turn Down Golf Course Cleanup Case

The General Electric Co. told the top court it should decline to review a cleanup suit by a golf course owner under the Resource Conservation and Recovery Act.

Courts clearly aren’t obliged to impose a hazardous waste cleanup order after a finding of liability under RCRA and no reason exists to hear the suit, GE said in a July 22 response brief.

Federal courts have always had discretion not to issue a RCRA injunction if the contamination is being addressed, the company said.
