Frontier Logistics LP failed to grasp the “elementary principle of civil procedure” in its attempt to avoid a federal water pollution lawsuit over the company’s alleged release of plastic pellets, according to a South Carolina federal court.
The lawsuit filed by environmental and conservation groups in the U.S. District Court for the District of South Carolina may proceed as sufficient injuries have been alleged, the court held.
