Forklift Cab Manufacturer Must Face Trial in Wrongful Death Suit

Contract Industrial Tooling Inc., an industrial equipment manufacturer, isn’t entitled to exit a wrongful death suit involving an allegedly defective forklift, a Louisiana federal court ruled.

The US District Court for the Western District of Louisiana found that Contract Industrial Tooling didn’t show that it was entitled to dismissal of a Louisiana Products Liability Act claim. Judge Terry A. Doughty found Thursday that there was a genuine dispute of material fact on the issue of whether a safer alternative cab design was feasible.
