Ford Truck Transmission Defect Claims Can Proceed, Court Says

Consumers’ claims that Ford Motor Co. put defective transmissions in F-150 trucks will advance, after a federal court in Michigan said it had jurisdiction.

Michael Barcelona and other plaintiffs in the potential class action can move forward claims under the Magnuson-Moss Warranty Act, which allows consumers to seek damages from suppliers, warrantors, and service contractors, the US District Court for the Northern District of Illinois said in a Wednesday opinion. Judge Jeffrey I. Cummings denied Ford’s partial motion to dismiss for lack of subject matter jurisdiction.
