Ford Fume Class Claim Runs Into Recall Law, Other Case

A consumer suing Ford Motor Co. over exhaust fumes that allegedly enter Ford vehicles essentially seeks a recall under an Illinois consumer-protection law, the U.S. District Court for the Northern District of Illinois ruled (Schiesser v. Ford Motor Co., 2017 BL 114606, N.D. Ill., 16 C 730, 4/6/17).

That puts the would-be class action into conflict with federal law, the court said.

Further, Ford has agreed to settle another class action, Sanchez-Knutson v. Ford Motor Co., over the exhaust fumes, the court said. Principles of judicial efficiency and comity, or courtesy, require the dismissal of the consumer-protection claim, ...
