FMC Beats Asbestos Claims By Estate of Shipyard Worker

FMC Corp. and several other companies won dismissal of asbestos claims by the estate of a shipyard worker because they were untimely.

The estate’s failure to file personal injury claims against the defendants within the three-year time limit extinguished its wrongful death claims against them, the U.S. District Court for the Western District of Washington said April 25.

Though the claims were filed within three years of the worker’s death, the three-year time limit for wrongful death claims doesn’t allow the case to go forward, the court said.
