Flaxseed Maker Defeats Suit Over Cadmium Non-Disclosure, for Now

Bob’s Red Mill Natural Foods Inc. convinced a federal judge to dismiss a proposed class action alleging its flaxseed products were deceptively advertised because their packaging makes health claims but doesn’t disclose the presence of cadmium.

Mark Hayden, the consumer who brought the suit, failed to adequately allege that the levels of cadmium in the flaxseed products makes them unhealthy, the US District Court for the Northern District of California said Tuesday.

Hayden alleged phrases like “To Your Good Health,” “You Can See Our Quality,” “amazing nourishment,” and other statements gave the impression the products didn’t have harmful ingredients like ...
