Fitbit Plaintiffs’ Lawyers Seek $7M in Fees After Settlement

Fitbit plaintiffs’ attorneys want a federal court to approve $7.3 million in fees following settlement of a class suit alleging the wearables don’t accurately track sleep.

Plaintiffs from several states sued Fitbit Inc. over representations that some devices could track “hours slept,” “times woken up,” and “quality of sleep.” The users said that, actually, the wearables only track movement, which isn’t a proxy for sleep.

The settlement, which got an early nod from the U.S. District Court for the Northern District of California in December 2018, gives class members a cash payment of $12.50 for each covered product purchased. There ...
