Expert Testimony Over Mirena Contraceptive Rejected

Bayer Healthcare Pharmaceuticals Inc. scored a win when a court tossed evidence from experts who sought to link its Mirena contraceptive with a condition that causes severe headaches.

Expert testimony that a product can cause the alleged harm is almost always necessary in medical product cases. Bayer won a previous round of Mirena litigation because the plaintiffs didn’t have expert testimony linking the device to the harm alleged in that case.

The Mirena intrauterine device releases a hormone known as levonorgestrel, which plaintiffs say caused them to suffer from idiopathic intracranial hypertension.
