Expert testimony is a must in a suit by a man alleging he suffered a stroke caused by Four Loko, formerly a caffeinated alcoholic beverage, manufacturer Phusion Projects LLC tells a federal trial court in Texas in a June 28 reply brief.
Phusion sought summary judgment in May on Robert Villa’s product liability claim, arguing the plaintiff failed to produce any expert testimony to demonstrate a causal link between Four Loko and his harm.
Villa opposes judgment, arguing a jury can determine causation in his case based on general experience and common sense (40 PSLR 702, 6/25/12).
