EPA Inaction on Colorado Ozone Plan for Denver Draws Lawsuit

The EPA’s failure to act on Colorado’s plan for reducing ozone pollution in the Denver area jeopardizes the public’s health and violates federal law, environmental groups told a federal court in the state.

The U.S. Court of Appeals for the Tenth Circuit granted the Environmental Protection Agency’s request to further look at its initial approval of the state’s plan in January 2021. Since then, the agency hasn’t published a final rule or decision on Colorado’s proposed infrastructure state implementation plan for the 2015 eight-hour ozone national ambient air quality standard.
