The Department of Energy will take title to 112 metric tons of elemental mercury from Nevada Gold Mines LLC after a federal trial court in Washington, D.C., granted the department’s motion to vacate and remand its mercury fee rule to address errors.
The department agreed to vacate and remand the rule to settle Nevada Gold Mines’ suit filed in January in the U.S. District Court for the District of Columbia.
The department conceded in a Sept. 3 filing that it made errors, omissions, and unclear statements in the rule.
