DuPont Can’t Relitigate Claims, PFAS Plaintiffs Tell Court

Lawyers for Ohio and West Virginia residents suing DuPont over PFAS exposure say a federal appeals court should reject the chemical manufacturer’s bid to relitigate claims that were resolved in previous proceedings.

In a Wednesday brief to the U.S. Court of Appeals for the Sixth Circuit, plaintiffs’ attorneys accused DuPont of exaggerating the impact of a recent lower court decision in order to gain an advantage in an upcoming trial.
