DraftKings, FanDuel Liable for Aiding Pro Players, Families Say

DraftKings Inc. and FanDuel Inc. can face liability as gambling “winners” because they favored professional fantasy sports players in order to increase their revenue streams, family members of losing contestants told the District of Massachusetts.

The plaintiffs are pursuing claims under the loss recovery acts of five states as spouses or parents of daily fantasy sports players who lost money playing such games online.

Some of those state laws don’t limit recovery to claims against a gambling winner, the plaintiffs said. And those states that do, recognize that the “winner” isn’t always the technical winner, they said.
