Dow Breast Implant Settlement Payments Properly Authorized

The facility managing the $2 billion Dow Corning breast implant settlement properly authorized some early second-priority payments, a federal appeals court said.

A district court didn’t err in finding that there would be sufficient funds to guarantee payment of all first-priority claims, the U.S. Court of Appeals for the Sixth Circuit said in a Dec. 13 unpublished opinion.

Dow Corning Corp., now known as Dow Silicones Corp., faced massive tort liability in the 1990s stemming from breast implant litigation.

The company and plaintiffs agreed on a reorganization plan that created a $2 billion settlement facility to pay breast implant claims. ...
