Prime Hydration Consumers Get Approval to Revise Marketing Suit

Consumers can reassert claims that Prime Hydration LLC, a beverage company founded by YouTubers Logan Paul and KSI, conducted a misleading marketing campaign to sell high-caffeine energy drinks to children.

The second amended complaint contains specific allegations, including ones about strategic decisions that were “instrumental” in the supposedly misleading advertising of Prime products, Chief Judge Greg N. Stivers of the US District Court for the Western District of Kentucky wrote Tuesday. This satisfied the heightened pleading standards for cases concerning fraud, Stivers said.
