DePuy Orthopaedics Inc. and associated businesses won dismissal of breach of warranty and misrepresentation claims against them in a suit involving a hip-replacement surgery that allegedly went awry, a federal court said.
John Muldoon’s breach of warranty claims were dismissed Tuesday by Judge Phyllis J. Hamilton of the US District Court for the Northern District of California because he didn’t show that he had a sufficiently direct relationship with the DePuy defendants and his misrepresentation claims were dismissed because he didn’t claim the needed specificity.
The defendants include DePuy Orthopaedics Inc., DePuy, Inc.,
