CVS Bid for New Look Rejected in Hand Sanitizer False-Ad Suit

CVS Health Corp. might have to face a class suit alleging it deceptively marketed hand sanitizer products as capable of killing “99.99% of germs.”

A federal appeals court declined to revisit a panel ruling that directed a district court to revisit lead plaintiff Joseph Mier’s bid for class certification.

  • Mier raised fraud allegations as well as claims under California’s Unfair Competition and False Advertising Laws against CVS Health, CVS Pharmacy Inc., and manufacturer Vi-Jon LLC
