Conagra Defeats Suit Over Parkay Spray No Fat, No Calorie Claims

Conagra Brands Inc. defeated a long-running class suit alleging it dupes consumers into thinking its Parkay Spray butter alternative has no fat and no calories, as a federal court in California said federal food labeling law preempts the claims.

Erin Allen alleged on behalf of a certified state class that Parkay’s representation is based on an artificially small serving size, in violation of Food and Drug Administration regulations.

Conagra uses the serving size for “spray type fat or oil,” but should use the larger serving size for the FDA’s “butter, margarine, oil, and shortening” category, her suit said. With the ...
