A Comfort Inn is liable for a child’s swimming pool death, but a new trial is required to reconsider damages, a Kentucky appeals court ruled May 17.
The jury was properly instructed and its verdict was supported by adequate evidence, the Kentucky Court of Appeals said. But it should have awarded damages for lost future earnings, pain and suffering, and loss of consortium, it said.
