Colonial Pipeline Co. won dismissal of an Alabama property contamination suit when a federal trial court in the state said Valley Creek Land & Timber LLC’s claims were premature.
Valley Creek, a land and timber investment company, alleged a 2016 gasoline spill from one of Colonial’s pipelines contaminated investment property with toxic chemicals, diminishing its value.
But Valley Creek’s claims aren’t yet ripe for adjudication because of ongoing mitigation efforts under a contractual agreement between Colonial and Valley Creek, the U.S. District Court for the Northern District of Alabama said.
