Colgate-Palmolive Beats Class Status Over White Teeth Promises

Colgate-Palmolive Co. fended off plaintiffs’ appeal of a ruling that denied class certification in a suit alleging it falsely represents the effectiveness of its Optic White toothpaste.

The federal trial court appropriately required the plaintiffs to show, as a constitutional threshold for classwide application of California law to a ten-state-class, that California had the requisite contacts to each class member’s claims, the U.S. Court of Appeals for the Ninth Circuit said June 24.

And the district court didn’t err in finding the plaintiffs failed to satisfy that burden, the appeals court said in an unpublished order.
